Case: Charles R. Bilyeu v. Frani Bilyeu (NFP)

This is a “not for publication” case, which I typically do not circulate on this list, but I found this case notable. Here, the Indiana Court of Appeals reversed a trial court because the trial court, sitting in a divorce case, first found that the parties’ premarital agreement was valid and enforceable, but then subsequently ordered Husband to contribute $5,500 to Wife’s attorney’s fee — even though the premarital agreement included an attorney fee waiver provision. The trial court’s attorney fee award was reversed.
